Ryan and Ryan

City of Chicago v. Koff, 341 N.E. 520 (Ill. 1930)

“In all cases where private property is taken for public use, the compensation to which the property
owner is entitled is the money necessary to put him in as good condition financially as he was
with the ownership of the property.  Nothing short of that amount conforms to the constitutional requirement of just compensation.”

Relocation Payments and Moving Costs

Ryan and Ryan lawyers have helped many of our clients obtain relocation payments and moving costs. Before January 1, 2007, such payments were required only for projects that were federally funded, although some public bodies voluntarily paid at least partial costs.

For cases filed after January 1, 2007, the Illinois Eminent Domain Act requires that every public body pay relocation and moving costs. That includes the costs of disconnecting all equipment and personal property, packing such material, transporting it to the new location, remodeling the new location if necessary to install the equipment and personal property.

In 2005, Ryan and Ryan negotiated a relocation payment for one of our clients of $11,286,035.
