Most eminent domain cases or condemnations for roads involve partial takings of private property rather than full takings. Under Illinois law, an owner whose property is being condemned is entitled to just compensation not only for the property lost but also for damages to the remainder, if the taking reduces the value of the remaining property held by the property owner. These partial taking cases many times involve a wide range of issues including how to value the partial, fee-simple strip taking, how to value permanent easements and temporary construction easements, the negative effect such takings have on the remainder of the property, and what damages are compensable under Illinois law. Road projects involving eminent domain can eliminate driveways, limit access, reduce parking spaces, obstruct internal traffic flow, change the property’s highest and best use, eliminate landscaping and screening, increase proximity to the new road, and cause the property to no longer conform to state and local laws and regulations.
