Illinois Road Projects and Partial Takings
Skilled Illinois and Chicago Area Eminent Domain and Condemnation Lawyers Defending Private Property Owners Against IDOT and Illinois Tollway.
Approximately 50% of the eminent domain and condemnation cases handled by Ryan & Ryan on behalf of private property owners in Illinois involve forced acquisitions of private property by the Illinois Department of Transportation (“IDOT”) and the Illinois State Toll Highway Authority (“ISTHA” or “Tollway”) for the construction of new roads, highways, and expressways, as well as restructuring and widening existing roads, highways, and expressways. We help protect private property interests and fight for just compensation for every one of our clients in every Illinois Tollway or IDOT condemnation case.
Examples of IDOT and Illinois Tollway Projects in DuPage, Cook, Lake, Kane, McHenry and Will Counties
Ryan & Ryan has represented clients in all the major road projects in northern Illinois. For example, Ryan & Ryan represented numerous property owners involved in the I-355 Tollway project in DuPage and Will Counties; Elgin O’Hare Expressway (I-390) and the Western Bypass Tollway projects; I-294 Central Tri-State Tollway reconstruction project; IDOT’s widening of Route 22 in Lake County; Lake Street, York Road, Elmhurst Road, and Rohlwing Road in DuPage County; Route 59 in Will and DuPage Counties; 159th Street and 135th Street in Will and Cook Counties; Route 45/LaGrange Road in Cook County; Weber Road in Will County, Longmeadow Parkway in Kane County, and Route 31, Route 47 and Route 14 in McHenry County.
Most eminent domain cases or condemnations for roads involve partial takings of private property rather than full takings. Under Illinois law, an owner whose property is being condemned is entitled to just compensation not only for the property lost but also for damages to the remainder, if the taking reduces the value of the remaining property held by the property owner. These partial taking cases many times involve a wide range of issues including how to value the partial, fee-simple strip taking, how to value permanent easements and temporary construction easements, the negative effect such takings have on the remainder of the property, and what damages are compensable under Illinois law. Road projects involving eminent domain can eliminate driveways, limit access, reduce parking spaces, obstruct internal traffic flow, change the property’s highest and best use, eliminate landscaping and screening, increase proximity to the new road, and cause the property to no longer conform to state and local laws and regulations. The eminent domain lawyers at Ryan & Ryan have handled partial takings on behalf of home owners and business owners involving damages to the remainder caused by the above mentioned issues as well as a myriad of other issues.
